1Acceptance of Terms

By creating an account, signing in, downloading the app, purchasing products, or using any part of Speak Up Board, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you may not use our services.

You must be at least 18 years old to create an account. Our services are intended for parents, guardians, and caregivers to use on behalf of, and together with, the children in their care.

2Description of Service

Speak Up Board is an educational, picture-based communication and learning platform designed to help children build language and communication skills. Depending on the version and plan you use, our services may include:

• A Talk Board with picture-based vocabulary that builds spoken sentences.
• Inclusive picture cards in a range of skin tones for boys and girls, plus family members and community helpers.
• Learning games covering letters, spelling, numbers, math, colors, shapes, time, money, and more.
• Child profiles with personalized settings, and progress tracking with skill badges.
• Additional content and libraries, such as games, books, coloring pages, videos, and sounds, where offered.
• Digital and physical educational products available through our website store.

Features may change as we improve the service, and some features are only available on certain plans or versions.

3Accounts & Sign-In

To use the Speak Up Board app, a parent or guardian must sign in with a Google account. You agree to:

• Provide accurate and complete information.
• Keep your Google account and your Parent PIN secure, and not share them with others.
• Notify us right away if you suspect unauthorized access to your account.
• Be responsible for all activity that happens under your account.

You may create child profiles under your account and are responsible for making sure the information you provide about children in your care is accurate. Plans may limit the number of child profiles and devices that can be used with one account.

4Acceptable Use

You agree to use Speak Up Board only for lawful purposes and in line with these Terms. You agree not to:

• Use the service for any unlawful purpose or in violation of any regulations.
• Attempt to gain unauthorized access to any part of the service.
• Interfere with or disrupt the integrity or performance of the service.
• Reverse engineer, decompile, or disassemble any part of the app.
• Use automated tools to scrape, crawl, or extract data from the service.
• Share your account credentials with others.
• Use the service to harass, abuse, or harm others.

5Plans, Purchases & Payments

Subscription plans

Some versions of Speak Up Board require a paid subscription plan. Plans, prices, and what each plan includes are shown on our website and in the app at the time of purchase. Plans may be billed monthly or yearly, and optional add-ons may be offered.

• New accounts may be offered a free trial. When the trial ends, continued access to paid features requires an active plan.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period.
• No partial refunds are provided for unused portions of a billing period, except where required by law.
• We may change plans or prices. We will give notice before a price change affects your next billing period.

In-app purchases (Google Play)

Purchases made within the Android app are processed by Google Play Billing and are subject to Google Play’s policies. We honor Google Play’s standard refund window of 48 hours after purchase.

Website store (Squarespace)

Physical products, such as books, coloring books, and apparel purchased through speakupboard.com, are processed by Squarespace. All sales are final unless a product arrives defective or damaged. Contact us within 14 days of receiving a damaged product for a replacement or refund.

6Intellectual Property

All content within Speak Up Board, including images, illustrations, sounds and voice recordings, graphics, text, logos, game designs, books, and educational content, is owned by Speak Up Board or its content suppliers and is protected by copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the app and its content for personal, non-commercial purposes only. You may not:

• Copy, reproduce, or distribute any content from the app without written permission.
• Use our logo, brand name, or content for commercial purposes.
• Create derivative works based on our content.
• Remove any copyright or proprietary notices from our content.

7Privacy & Children

Your use of Speak Up Board is also governed by our Privacy Policy, which is part of these Terms. We take children’s privacy very seriously and comply with applicable laws, including COPPA.

8Disclaimers

Speak Up Board is provided on an “as is” and “as available” basis, without warranties of any kind. We do not warrant that:

• The service will be uninterrupted or error-free.
• The service will meet your specific requirements.
• Any errors in the service will be corrected.

Speak Up Board is a picture-based communication and learning support tool. It is not a medical device and does not replace speech therapy, evaluation, or professional care. Educational outcomes vary, and we do not guarantee specific results.

9Limitation of Liability

To the maximum extent permitted by law, Speak Up Board shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our services.

Our total liability to you for any claims arising from these Terms or your use of the service shall not exceed the amount you paid us in the 12 months before the claim.

10Termination

We may suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time by contacting us.

When your account ends, your right to use the service ends immediately, and we will delete your data in line with our Privacy Policy.

11Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by email or through the app, and the “Last updated” date at the top of this page will change. Continuing to use Speak Up Board after changes take effect means you accept the updated terms.

12Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-law rules. Any disputes arising under these Terms shall be resolved in the courts of Michigan.
