Speak Up Board Terms of Service

These Terms of Service explain the rules for using Speak Up Board, including our application, website, educational content, digital products, physical products, and related services.

By using Speak Up Board, creating an account, downloading the app, or purchasing products, you agree to follow these Terms of Service.

By creating an account, downloading the app, or using any part of Speak Up Board, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.

You must be at least 18 years old to create an account. Our services are intended for use by parents and guardians on behalf of children in their care.

Speak Up Board is an educational communication and learning platform designed to help children develop language and communication skills. Our services include:

• An interactive communication board with picture-based vocabulary.
• Learning games covering grammar, colors, numbers, letters, and more.
• Child profile management with personalized settings.
• Progress tracking across learning activities.
• Digital and physical educational products available through our store.

To use Speak Up Board you must create an account using a valid email address or Google account. You agree to:

• Provide accurate and complete information when creating your account.
• Keep your login credentials secure and not share them with others.
• Notify us immediately if you suspect unauthorized access to your account.
• Be responsible for all activity that occurs under your account.

You may create child profiles under your account. You are responsible for ensuring that all information you provide about children in your care is accurate.

You agree to use Speak Up Board only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the service for any unlawful purpose or in violation of any regulations.
• Attempt to gain unauthorized access to any part of the service.
• Interfere with or disrupt the integrity or performance of the service.
• Attempt to reverse engineer, decompile, or disassemble any part of the app.
• Use automated tools to scrape, crawl, or extract data from the service.
• Share your account credentials with others.
• Use the service to harass, abuse, or harm others.

Website Store — Squarespace:

Physical products such as coloring books and merchandise purchased through speakupboard.com are processed by Squarespace. All sales are final unless the product is defective or damaged. Please contact us within 14 days of receiving a damaged product for a replacement or refund.

In-App Purchases — Google Play:

Digital content purchased within the Android app is processed by Google Play Billing. All in-app purchases are subject to Google Play's refund policies. We honor Google Play's standard refund window of 48 hours after purchase.

Subscriptions:

If we offer subscription plans you may cancel at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a subscription period.

All content within Speak Up Board including but not limited to images, sounds, graphics, text, logos, game designs, and educational content is owned by Speak Up Board or its content suppliers and is protected by copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the app and its content for personal, non-commercial purposes only. You may not:

• Copy, reproduce, or distribute any content from the app without written permission.
• Use our logo, brand name, or content for commercial purposes.
• Create derivative works based on our content.
• Remove any copyright or proprietary notices from our content.

Your use of Speak Up Board is also governed by our Privacy Policy which is incorporated into these Terms by reference. We take children's privacy very seriously and comply with applicable laws including COPPA.

Speak Up Board is provided on an "as is" and "as available" basis without warranties of any kind. We do not warrant that:

• The service will be uninterrupted or error-free.
• The service will meet your specific requirements.
• Any errors in the service will be corrected.

Educational outcomes may vary. While our app is designed to support children's communication and learning development, we do not guarantee specific educational results.

To the maximum extent permitted by law, Speak Up Board shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services.

Our total liability to you for any claims arising from these Terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time by contacting us.

Upon termination, your right to use the service will immediately cease and we will delete your data in accordance with our Privacy Policy.

We may update these Terms of Service from time to time. We will notify you of significant changes by email or through the app. Your continued use of Speak Up Board after changes become effective constitutes your acceptance of the new terms.

These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Michigan.
